- INTRODUCTION
1.1 Welcome to www.mythiko.com
This website is the online shop, (hereinafter “Mythiko”, “Website”, “we”, “our” “us”), and ownership of the sole proprietorship Theodoros Moulios under the brand name MYTHIKO, at 59 Nikiforou Theotoki St., 49100, Corfu, Greece. (VAT no.: EL 103209720).

1.2 These present Terms and Conditions of Use and Sale (hereinafter “T&C”), aim to set forth in a clear and comprehensive manner, abiding to the principles of good faith and to provisions on the validity of contracts, the terms and conditions governing the relationships between Mythiko and any visitor or/and customer of Mythiko (hereinafter “Visitor”, “Customer”, “User”, “you”, “your”), in accordance with Greek Legislation on Consumer Protection and Protection of the individual from processing of Personal Data, as in force today, as well as with E.U. Consumer Law.

1.3 Confirm that you have fully read, understood and accepted these present T&C. Each and all of your entries, navigations and transactions with the Website renders you a Visitor or/and Customer of Mythiko. All entries or/and uses or/and transactions hereinafter with Mythiko through the Website presupposes your full unconditional and explicit acceptance of these T&C, as well as any other term that meets the requirements of the law and may be located within this website, in addition to this text, indicatively in the following positions: “Shipments”, “Rescission”, “Privacy”.

1.4 Mythiko reserves the right to amend or update in writing these present T&C without prior notice, effective as of the date posted on the Website.
Mythiko reserves the right from time to time to modify or discontinue the operation of the Website (or any part or content thereof), for maintenance or upgrade, without notice at any time.
Mythiko reserves the right to refuse service or sale to anyone for any reason at any time.

- COPYRIGHTS
2.1 The entire content of the Website, including pictures, graphics, photographs, designs, texts, overall layout, services provided and products and in general all files and databases of Mythiko are the intellectual property, industrial designs, trade names, distinctive marks, signs, symbols and registered trademarks and service marks of the Shop and are protected by the relevant provisions of Greek and European law as well as those of international agreements, protocols and conventions.

2.2 The entire content of the Website is independently protected as original works of conjectural design and applied arts, according to specific requirements of law. Mythiko’s distinguishing features, like names and logos, are protected by the Greek, European and international law that applies to trademarks. Under the applicable law, this website’s content is protected from violation of Industrial Property, which belongs to Mythiko, without prejudice to the rights of other holders-agents.

2.3 You are not allowed to download, record and direct or indirect, temporary or permanent reproduction of all works contained in the Website. There is also forbidden any kind of deformation, abridgement or other modification of the aforementioned works, as well as any insult of the creator caused by the conditions of the work’s presentation.

2.4 The contents may not be reproduced, duplicated, republished, sold, copied, distributed, transmitted, broadcast or modified or otherwise exploited in any manner whatsoever, in part or in full, for any commercial purpose, without the prior express written consent of the company.

2.5 Under no circumstances should the display and view of this website’s content be construed as a transfer and/or cession of authorisation and/or its right of use to anyone.

- PRODUCTS
3.1 We make every effort to ensure a realistic and accurate photographic representation for the majority of the products sold through the Website. Yet, due to monitors colors or other technological limitations, these representations may vary from the actual condition, form and image of the products. Please also note that it’s natural for some handmade products, even if the design is the same, to be slightly different from those of the display photos.
3.2 We try to maintain accurate stock counts on our website but in no case can guarantee it. From time to time there may be a stock discrepancy and we will not be able to fulfill your order at time of purchase. In this case, we undertake to inform you in a timely manner about the unavailability and whether you would prefer to await restocking or if you would prefer for us to process a refund.
- PRICES
The prices indicated next to each product include VAT. Mythiko reserves the right to adjust prices without notice, without prejudice to already confirmed orders. Customers should always pay the total amount cited on the invoice even if the price has changed by the time the order is delivered.

- ORDERS AND PAYMENTS
5.1 The online products list on the Website constitutes an invitation to the Visitor / User to submit an order of buying the Products. You can submit your order as a Registered User (User) or an unidentified user (Guest User). The submission of a product order by the Customer is a binding proposal for a purchase contract of the said products at the total price indicated during submission of the order, including V.A.T., packing and shipping expenses, other applicable fees and any discount to which may be entitled. Payments are debited from your card or your PayPal account once your order becomes final. Your order becomes final upon acceptance from Mythiko, by confirmation email at the email address you indicated, upon submission of the order. Should you pay your order until you receive your “order confirmation” email, your money will be taken as a financial guarantee for the execution of the agreement (contract) and will be refunded immediately if your order is not confirmed. Should you fail to receive a confirmation message of your order, we kindly ask you to contact Mythiko as soon as possible at service@mythico.com in order to request that submission of your order is successfully completed. The confirmation email includes an order tracking link.

5.2 After that, your order proceeds to the stage of collection and you will receive an email when the products are ready to be shipped to the indicated shipping address (or in case of multiple deliveries, to the shipping addresses). The shipping of the products will be carried out according to article 7 below.

5.3 In case there is an unexpected shortage from the suppliers, for any reason, in one/some of the products you have ordered, we will make efforts to contact you via the email address you have indicated, to consult with you on the execution or any modification, correction or cancellation of your order. In case we have not been able to contact you for up to 3 business days, then we will assume your acceptance and your order will proceed for collection and execution. In any case, you will be notified of any modification via the email address you have indicated. This email will also constitute a confirmation of your order.

5.4 Mythiko provides the following payment methods:
- Credit, debit or prepaid card: Visa, MasterCard or Maestro
- Bank transfer or deposit.
- PayPal
- Cash on delivery (only within Greece).

- TRANSACTION SECURITY
Mythiko’s cooperation with Eurobank, a pioneer in the field of secure online/electronic transactions, guarantees credibility and security of your purchases through the Website. Eurobank e-Commerce service fully supports the EMV 3D Secure (upgraded 3D Secure) protocol that secures online card payments.
To reduce the risk of fraud for electronic transactions, it implements strong Customer identification (Strong Customer Authentication – SCA). Your personal information when you pay by card in the Website is protected by the TLS (Transport Layer Security) protocol. Transfer encrypted to 256bit with SSL (Secure Sockets Layer) protocol. During online payments you are automatically transferred to a secure, encrypted page owned exclusively by Eurobank, through the installed SSL protocol system, where you enter your card details safely. Your card details are encrypted and sent to the Bank that has issued your card for billing approval. Eurobank notifies Mythiko when the payment has been completed. Thus, Mythiko does not have access nor stores your personal data, e.g. card number and expiration date, code CVV2 / CVC2.
Eurobank uses Firewall technology to prevent any unauthorized access to its systems. Firewall allows certain services, while blocking others. Moreover, it prohibits unidentified users from accessing systems and databases that contain confidential data and information.

- SHIPPING & DELIVERY
– You will be asked to select the shipment method you would prefer as part of the order procedure. You will be asked to provide a telephone number on the page of Checkout, which is important if the courier needs additional information to insure a successful delivery. You will also be asked to provide an email address, to which we will send confirmation that your order was placed.
– We recommend you to include also a mobile phone numper in order to ensure your easy and direct communication with the courier.
– Orders are subject to verification and acceptance before shipping. We reserve the right to cancel orders. Orders are processed among two bussiness days contingent to their acceptance and their verification. (Please note this may take little longer during our high peak summer season).
– Once your order has been complete and handed over to the courier, you will receive the shipping confirmation email with your shipping details and the respective tracking number and management link through the carrier. Clicking on the tracking number takes you directly to the shipping carrier’s website, where you can follow the progress of your shipment(s). You will receive another notification (e-mail or sms), the morning of the delivery day.
7.1 Shipping Times:
- Greece: 1 – 3 business days, after dispatch, via ELTA Courier.
- EU and UK: 4 – 8 business days, after dispatch, via DHL European Road Freight.
- Rest of Europe: 8 – 14 business days, after dispatch, via DHL European Road Freight.
- Rest of World: 4 – 10 business days, after dispatch, via DHL Express Worldwide.
- Hellenic Post service available, upon need and request.
You may also check the transit time for road freight shipments in Europe.
You can expect your items to arrive by the estimated delivery date. Delivery timing is estimated from the time your order is shipped, not when it is placed. Please also note that the estimated delivery time is an estimate only and is not guaranteed, and vary depending on shipping locations. Your items may arrive sooner than the estimated delivery date. The actual delivery date will be calculated from the date on which your parcel will dispatch and is best indicated in the shipping confirmation mail. Mythiko is not responsible for any unanticipated delays beyond its control.
– It is of course possible to pick up from the Mythiko store during its opening hours. You come to the store with the code of your order, after first being informed that your order is ready for receipt.
– At the moment we are unable to ship to PO Boxes or freight forwarder addresses.
– At this time we can only ship to one address per order. To ship to multiple addresses, please place a separate order for each address.
– You may include the possibility to allow a third party to receive and acquire on your behalf the physical possession and control of the products, as long as you indicate it to us.
– The Mythiko Online Store provides the possibility to select a different Shipping Address from the Billing Address. That makes it easy to comfortably send an order to an office address or to a friend.
– If you need to modify your shipping or delivery information after your order has been placed, please Contact Us as soon as possible. Shipping information, including delivery address, cannot be modified once the order has already been shipped.
– We require a signature on delivery for orders totaling €1,000 or more.
– If your order weighs over 70kg, please contact us for special delivery arrangements.
– Shipping time for the “Bulk orders”, “Special orders”, “Corporate gifts” is determined upon contact.
– If you have set-up a personal account at the Mythiko Online Store, you will be able to view and track the status of your shipment in My Account. If you are not registered yet, you can still track your orders here but we suggest to sign up to comfortably track your future orders.
Through the On Demand Delivery tool, (provided that its available in your country), you can arrange a different delivery method online: service point, a different address, neighbours, delivery without signature or you can ask for delivery on a different day.
7.2 Shipping Cost
Products are dispatched at the cost of the addressee. Shipping cost vary according to the product(s) concerned, the chosen delivery method and the delivery area. Charges are calculated based on the volumetric weight and destination of your order. This amounts are indicated on:
a. “My Cart” page by entering the zip code of the destination, to the space given.
b. “Cheqout” page in “Order Summary” having added your details or placed an order.
The total will be displayed on the final page before payment is entered.
Deliveries in non-EU countries may be subject to additional import duties, taxes or delivery charges, which are levied once a shipment reaches a country and may vary widely from country to country. Customs duties are a type of tax on goods entering a country (Customs Duties, Excise duty and/or Import Tax, customs clearance fees, storage, etc.) and differ per country. Depending on the country, duties and taxes are settled with the post office or the customs office. Customs authorities at your chosen shipping address country, will calculate these taxes at the point of entry and you will need to make payment directly for these. Any such duties or locally collected taxes imposed, are not included on price and are payable by the addressee. Mythiko is not always aware of the amount of such charges. Value added taxes (VAT) are usually levied in the country where the purchased goods are consumed. You can find more information about customs on the website of your local customs authority. 7.3 Notes on process.
We make every effort to send your orders as soon as possible, with the proper care and required security. We work closely with our transport partners to transfer the order to you within the basic delivery schedule and minimize the potential impact of any shipping delays. However, in some cases, there are exogenous factors that may cause delays in deliveries, which should be mentioned.
1. We cannot guarantee the exact delivery time of the order. The cooperating courier companies undertake to deliver your orders within the above mentioned delivery times, which may differ when there are external factors (strikes, political upheaval, war, weather phenomena, natural disasters, pandemics, etc.). Also there may be restrictions in delivering to specific countries and if the shipping address is considered to be in an inaccessible area, delivery time may vary. Mythiko shall bear no liability in the event of failure to deliver by any such reason. Delays of up to 10 days are unfortunately possible.
2. In circumstances where the delivery period is essential, and that the receipt of the products up to a specific date is of paramount importance to you, it would be ideal to inform us before making the payment or otherwise mention it in the box: “Order notes”. Please note, that in this case, even if your deadline falls within the estimated delivery times, we reserve the right in some cases, in our discretion, to reject your proposal and if you have already made the payment, to fully refund you immediately.
3. In special cases, especially in orders connected with foreign countries, there may be a delay either during high peak seasons, or because of the workshop’s inability to provide us with the products at the expected times and delivery may take as long as, (but no more than), 30 days. In any such case of complexity/difficulty completing an order, we will contact you to confirm whether you want your order to proceed or cancel and refund. In any case the delivery time will be arranged in consultation with Mythiko.
4. What to do when your package hasn’t arrived.
In case your international shipment has not arrived within 10 days after the day you expected it, most of the time it got delayed somewhere, which you can simply check through our track-and-trace service. If the delivery status of your package remains unclear, be sure to contact us and the relevant local courier, straight away. When contacting customer service, you will be asked to provide the consignment number and, if possible, an accurate and detailed description of the goods and packaging. It will be checked with the distribution centres to find out if your shipment was perhaps addressed incorrectly or if its packaging got damaged or lost. If your package was not retained in one of the distribution centres, the search will continue to find out where things went wrong. Fortunately, most packages that don’t arrive did not get lost. In case the parcel of your shipment is found to be lost, we will contact you in order to inform us if you wish us to resend the order at our expense or refund the full payment immediately.
5. Mythiko insures most of the qualifying items, against accidental damage or theft when whilst in transit until it is delivered to the shipping address. Once your items have been delivered and signed for, they are no longer covered by insurance. If your box is damaged, upon arrival, we recommend that you either refuse the delivery, or make a note when signing for its receipt that you are accepting a damaged box.
6. Missed delivery.
You will receive a notification (e-mail or sms), the morning of the delivery day with one hour delivery space; at this point you can request also a “you are next” message. In a missed delivery incident, what usually happens is that a package got delivered outside office hours or when you weren’t home. If that is the case and your neighbours aren’t home either, you should find a card in your mailbox. Normaly the courier will automatically return the next workday. If you missed the second delivery attempt, you have five – fourteen workdays (depending on couriers local policy) to collect your parcel at the couriers nearest location.
Through the On Demand Delivery tool, (provided that its available in your country), you can arrange a different delivery method online: service point, a different address, neighbours, delivery without signature or you can ask for delivery on a different day.
7. Delivery failed cases due to Customers/recipients fault:
a. due to the recipient refusing to pay the customs duties of the destination country.
b. due to an incorrect or incomplete delivery address filled by the Customer in the order form.
c. due to the absence of a recipient at the provided shipping address.
In those cases the courier company, after the attempts to deliver, will leave notices, and try to contact the Customer, in accordance with the delivery policy of each one. We will contact the Customer as well, either by phone or by email. After 5- 14 days from the first notice and if we do not find any response or if the Customer unjustifiably refuses to receive the parcel, it will return to us. Orders refused by recipient upon delivery will be considered an “abandoned package” and ineligible for a refund.
8. In case we have failed to deliver within the period of time agreed, you have the right to call upon us to make the delivery within a reasonable additional period of time, appropriate to the circumstances. If we fail to deliver within that additional period of time, you shall be entitled to terminate the contract. The products will not be delivered and you will be refunded the full payment immediately.
9. Primary value for Mythiko is the relationship of “good faith” and honesty with its Customer. In any case, for any issue of support before and after the sale, delay, change, exchange or return of product, damaged parcels, order cancellation, withdrawal and any relevant questions – clarifications, please contact us immediately.
- RESCISSION
8.1. Mythiko sincerely hopes that you will be satisfied with your purchase. However, if for any reason you are not, you may:
a. Cancel / Change the order before shipping.
Cancel or Change an order (in whole or in part) that has already been confirmed but has not yet been shipped, and fully refund. Just let us know about this decision of yours by sending us an e-mail at service@mythiko.com or through the “CONTACT“ page, providing the order number.
This feature expires if you have been sent a shipping confirmation email.
b. Withdraw & return products after delivery.
Withdraw and return products within 14 days from the date of delivery and fully refund.
8.2. Withdrawal
As a Customer you have the right to withdraw from this contract, up to 14 days from the next day that you or a third party (not the carrier), which you have indicated, acquires possession of the products. In order to exercise this right you must inform us of your decision here: Mythiko, 59 Nikiforou Theotoki St., Corfu, Greece, +30 2661 03835, service@mythiko.com. You can also fill in and submit the model withdrawal form, (as given by the E.U. consumer rights directive 2011/83), selecting “Submit Withdrawal“, or any other unequivocal statement on our website. If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium without delay. To meet the withdrawal deadline, all you have to do is submit your statement within the deadline.
Exception from the right of withdrawal are the products made to the Customer’s specifications or clearly personalised (bespoked).
8.3. Effects of withdrawal
- If you withdraw from this contract, we shall refund you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such a refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such refund.
- We may withhold refund until we have received the products back or you have supplied evidence of having sent back the products, whichever is the earliest. You shall send back the products or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
- You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
- The products are returned at your own liability until they reach us.
- You will have to bear the direct cost of returning the goods.

8.4 Packing and Return
- You may return your order by any means you wish. (You are advised to send the products via the courier agency from which the order was originally received)*.
*We give you the opportunity to use the least expensive standard way of delivery that we have through the cooperating courier company. In this case we will arrange the pickup and bear the cost of returning the products and the amount of this cost will be deducted from the amount of your refund. The products, though, are returned at your own liability until they reach us and all the terms of “Withdowal and Return” apply in full. You bear the liability to keep to the pickup schedule you have indicated to us. If you wish this service please apply it in your withdrawal statement.

- At the time of delivery, we would recommend careful product check without destroying the packaging, so that the return can be accepted. The products should be returned in the same good condition you received them and must be accompanied by the relevant documents, labels, accessories etc (e.g. packing materials, receipt). Please be careful when handling our products. Make sure they are properly packaged so that they are not damaged during transport. In case you have decided to return all the products, before or upon delivery, do not unpack them but return them as they are.

- Once the product has been returned, checked and found to be in the state we delivered to you, we will notify you by email that the corresponding amount will be credited to your bank account.

- At Mythiko we take special care in the careful packaging of the products so that they reach you intact. However, in case a product is damaged during transport, please let us know as soon as possible, in order to deal with it.

- In case of repeated returns made by a Customer, Mythiko reserves the right to refuse the return of products, due to overuse of the right of withdrawal/replacement.

- USER REGISTRATION
The registration of the User in the Website is optional. Each Customer registers only once. The aim is to provide better and most complete service and to facilitate its future purchases. The Customer who registers as a User has the ability to see and track his orders, new and old, and modify the User details of his account.
The personal data provided by the User during his registration are processed by Mythiko in order to create an account on the Website, communicate with the User and send to him information, advertising and promotion material related to the products or the services of Mythiko. The data entered at the time of registration must be complete, true and up-to-date. Regarding the collection and processing of personal data, the terms and provisions of the Personal Data Protection Policy apply. All information you provide us is managed only by authorized personnel of the and fall under the our Privacy Policy followed and is collected and processed with the ultimate safe, care and diligence and only with your expressed consent. The User has the ability to withdraw his consent for the collection and processing of his personal data at any time, by terminating his account, sending a relevant email to service@mythiko.com.
- SAFETY
For your safe navigation in the Website, as well as for the security of your transactions with it, Mythiko takes every appropriate measure by adopting all high quality security standards, in accordance with market trends, such as high levels of SSL (Secure Socket Layer) encryption technology, that are activated during the input of sensitive personal data offering 256 bit encrypted communication. Please note that we do everything possible to protect your personal data and that the secure navigation in the Website, as the protection of the password in your personal account in the Website is up to you.

- LIABILITY OF THE PARTIES
11.1 Customers may make contracts with Mythiko only as long as they are adults and we do not bear any responsibility in case of use of this shop by minors, and in any such case, it is presumed that there is the required parental consent.

11.2 As a Visitor or/and Customer by accepting these present T&C and by navigating through the Website, you responsibly declare that you are legally eligible to enter into this present contract and to make use of the Website under the terms and conditions provided herein.

11.3 In addition, as a Visitor / User of the Website you agree and accept that you are financially liable for any and all use of the Website, as well as for the use of your account by others – including persons cohabiting with you – and therefore you agree to supervise all use of the Website made by under-aged persons using your account or name.

11.4 Visitors, and Customers are required – at making any kind of agreement with our Website – to provide full and accurate personal details required for making a valid agreement. Customers must without fail provide a valid email, to which they have access when ordering products.

11.5 The registration and participation of the User is personal, non-transmissible and non-transferable.
Users confirm the User’s sign up (Create Account) in Mythiko by following a link sent to the email they have provided when signing up, therefore, the individual who has access to that email procedure is unquestionably deemed by Mythiko to be the person who uses the member’s account in the Website.
Users must not disclose their passwords for accessing the Website to third parties. Users are solely liable for the safety of their passwords and any damage caused to the Website, to them or any third party by unauthorized use of their passwords.

11.6 You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation; (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

11.7 You agree to indemnify, defend and hold harmless Mythiko, its owners, directors, employees, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of theT&C. In any case, and provided that the company is responsible for any damage due to its proven negligence, the company is liable to cover only the actual loss of the injured party caused by and related directly to the harmful event and the company’s negligence. Likewise, all the limitations of liability set out in these terms of use apply and are recognised and accepted by the User/Customer/Visitor/member of Mythiko in their entirety as valid and consistent with good faith and commercial ethics.

11.8 Users agree and undertake not to use the Website for:
- sending, publishing, emailing or otherwise transmitting any content that is illegal, unlawful, abusive and contrary to the law in general;
- sending, publishing, emailing or otherwise transmitting any content that infringes on the confidentiality, privacy of any person, or the rights of the Constitution, or is discriminatory;
- posting, publishing, emailing or otherwise transmitting any content that is defamatory and / or false, infringing on Mythiko or any third part;
- sending, publishing, emailing or otherwise transmitting any content that is contrary to good faith, offends Users and business ethics, social values, minors, etc;
- posting, publishing, emailing or otherwise transmitting any content for which Users do not have the right to transmit in accordance with the law or the applicable conventions;
- sending, publishing, emailing or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright or other proprietary right of others;
- sending, publishing, emailing or otherwise transmitting any malicious or non-malicious file containing software viruses or any other code, files or programs designed to interrupt, cause damage, the destruction or operation of any computer software or hardware;
- intentional or unintentional breach of applicable law or regulations;
- harassment of third parties in any way;
- collect or store personal data about other Users.

11.9 Visitors / Users are required to act in compliance with the Greek law, including any generally accepted rules of International Law as well as of International Agreements, which from the moment they are ratified by law and put in effect pursuant to the terms of each of them, are an integral part of the Greek law and supersede any contrary provision of Greek Law, to respect and abide by any law of the European or International Law applicable in using the Website and its services, and to exercise their rights within the limits set by good faith, morality and social and financial purposes of their rights.

- LIMITATION OF LIABILITY
12.1 The presentation of the products and services on our Website has the character of an invitation to Users to submit a contract proposal and such presentation is not in any way a commitment of the company to the availability and proficiency of the products and services (127 fol. CC).

12.2 Mythiko shall not be liable for any temporary or permanent failure to provide its services, as well as for any delay in accepting and executing orders and delivering the ordered products by reasons beyond its control.

From time-to-time there may be a stock discrepancy and we will not be able to fulfill your order at time of purchase.
